RESOLUTION OF THE BOARD OF DIRECTORS OF
BARKLEY PARC HOMEOWNERS ASSOCIATION, INC.
NON-COMPLIANCE OF SWIMMING POOL AREA AND PLAYGROUND AREA RULES AND REGULATIONS
At a meeting of the BOARD OF DIRECTORS OF BARKLEY PARC HOMEOWNERS ASSOCIATION, INC. in Covington, LA (hereinafter referred to as "Association"), held on November 19, 2019, the following resolution was adopted:
WHEREAS, pursuant to Article VI, Section 1, Paragraph (C) of the Dedication of Servitudes, Easements and Restrictive Covenants for Barkley Parc Subdivision, the Association has the right to pass and enforce such rules and regulations for the use of the Community Facilities, including the right to enforce various sanctions against the Owners of Lots in Barkley Parc Subdivision, including, but not limited to, the right of suspension, fines and penalties, and assessments of the costs of noncompliance of an individual Lot Owner or other sanctions which in the discretion of the governing body of the Association deems necessary and proper.
NOW THEREFORE, BE IT RESOLVED the Board of Directors of Barkley Parc, does hereby establish the following guidelines for imposing fines and penalties, and the amount of the fines and penalties that will be imposed upon a Lot Owner's account for non-compliance of a Lot Owner, a Lot Owner's tenants, or a guest of a Lot Owner, of the swimming pool area and playground area rules and regulations, as posted at the swimming pool and playground, and posted on the Association's website.
First Offense: Warning letter will be mailed to Lot Owner notifying them of the act of noncompliance to the rules and regulations.
Second Offense: Fine of twenty-five dollars ($25.00) will be will be imposed due to non-compliance to the rules and regulations.
Third Offense: Suspension of Lot Owner's right to use the swimming pool area and playground area.
The Board of Director's reserves the right to immediately suspend, a Lot Owner's right to use the swimming pool and playground areas, if the Board of Directors determines that actions of a Lot Owner, or its tenants. or guests are dangerous or destructive to the welfare of the other Lot Owners and/or to the swimming pool or playground areas.
Lot Owner's may send in a written request for a Board Hearing to discuss any fines imposed or rights suspended.
